How to Sell Your Home in Halifax When One Partner Refuses

Separation is hard enough. Add in a property dispute and things go from “conscious uncoupling” to “conscious chaos” real quick. If you’re trying to sell your home in Halifax—but your ex is digging in their heels—you’re not alone, and you’re definitely not without options.

Let’s break down the facts (and the feelings) and get you moving—literally and legally.


Why Can’t We Just List It?

Because technically, both owners have to agree to the sale. Even if you’re the one paying the mortgage, if both names are on the title, you both have to sign off on the listing agreement, the offer, and the closing paperwork.

And no, changing the locks isn’t a solution (tempting, I know).

So, What Can You Actually Do?

This is where the legal meets the logical:


1. Try Mediation First

If things are even mildly civil, a neutral mediator can help both parties come to terms, without heading straight to court. It’s faster, cheaper, and generally less soul-sucking than litigation.

2. Apply to the Court

If they still refuse to cooperate, you can file a partition and sale application in Nova Scotia Supreme Court. This forces the sale of jointly owned property, even if one party objects. But keep in mind—it’s a process. And the court will want to see you made a good faith effort to resolve things beforehand.

3. Offer to Buy Them Out

If you want to stay in the home, you can offer to buy out their share. You’ll need a proper appraisal and ideally a lawyer to draft terms. (Note: a verbal "fine, you can have it" doesn't count.)


Can I Sell Without Their Permission?

Short answer: Nope. Not legally. Even if you’re emotionally so done with this house, your ex still has rights unless removed from title through a legal process.
